Accepting these terms

These terms apply when you use this website or hire Sterling Sioux Falls Concrete Company for concrete work. In these terms, "we," "us" and "our" mean Sterling Sioux Falls Concrete Company, and "you" means the person using the site or the homeowner or property owner we're working for.

By using the site, asking for an estimate or booking a job with us, you agree to these terms. If you don't agree, please don't use the site. You can still call us at (605) 305-1165 with any questions before you decide.

Your written estimate or signed contract for a specific job controls if it says something different from these terms.

What we do

We're a concrete contractor in Sioux Falls, SD. We build driveways, patios, sidewalks, steps, garage floors, slabs, footings, foundations, retaining walls, pool decks and parking lots, and we also do stamped and decorative concrete, foundation raising and concrete cutting. We work in Sioux Falls and the cities around it.

The information on our home page, our service pages and our About page describes our work in general terms. It's not a promise about any particular job, because every site has its own soil, drainage, access and existing concrete. The exact scope of your job is the scope written in your estimate or contract.

Estimates and pricing

Our estimates are free, done in person and carry no obligation. An estimate is based on what we can see and measure at your house on the day we visit, along with the materials and labor costs at that time.

Prices can change if the job changes. That includes a change you ask for, such as a larger area or a different finish, or a condition we couldn't see until the old concrete was out, like soft or wet subgrade, which is the ground a slab sits on, buried debris or roots. When that happens, we'll tell you what we found and what it will cost before we do the added work.

An estimate is good for the period written on it. After that, we may need to update the price before we schedule the work.

Scheduling, weather and cancellation

We'll give you a start date when you book, but concrete work depends on the weather. We may move a pour if rain, freezing temperatures or extreme heat would hurt the finished slab, and we'll contact you as soon as we know. Moving a date for weather or ground conditions isn't a breach of our agreement.

New concrete needs time to cure, which is the waiting period while it hardens and gains strength. We'll tell you when it's safe to walk on and drive on your new slab. Damage caused by using it sooner than we advised isn't covered.

If you need to reschedule or cancel, please let us know as early as you can by phone or through our Contact page. If we've already ordered materials, prepared the site or started work, you're responsible for those costs as described in your contract.

Payment terms

Payment amounts, due dates and any deposit are set out in your estimate or contract. Unless your contract says otherwise, the balance is due when the work is finished.

If a payment is late, we may pause work until the account is current. Where South Dakota law allows, we may also add reasonable late charges, collection costs and lien rights for unpaid work on your property.

Our guarantee and what it doesn't cover

We're licensed and fully insured, and our work is backed by our satisfaction guarantee. If something about the finished job isn't right, call us and we'll come look at it with you. The details of any guarantee or written warranty for your job are in your contract.

Concrete can develop small hairline cracks over time even when it's built correctly, because it shrinks as it cures and moves as the ground freezes and thaws. We cut control joints, which are planned grooves that give the slab a place to crack where you won't notice it, but no contractor can promise a slab will never crack. Hairline cracks, small color differences between pours and normal surface wear are not defects.

Our guarantee doesn't cover damage from things outside our control, including soil movement, flooding, poor drainage from other parts of your property, tree roots, deicing salts, heavy vehicles beyond what the slab was built for, or use before the concrete has cured.

Apart from what's written in these terms or your contract, the website and our services are provided without other warranties of any kind, to the extent South Dakota law allows.

Limitation of liability

To the fullest extent the law allows, Sterling Sioux Falls Concrete Company isn't liable for indirect, incidental or consequential damages, such as lost use of your property or lost income, that come from our work or from using this website.

If we are found responsible for a loss, our total liability is limited to the amount you paid us for the job that gave rise to the claim. Nothing in these terms limits liability that can't be limited under South Dakota law.

Resolving a disagreement

If you have a problem with our work or a bill, please call us at (605) 305-1165 or reach us through our Contact page first. Most issues get settled quickly once we're on site and looking at the same thing you are.

If we can't work it out together within a reasonable time, either of us may bring the matter to a state or federal court located in South Dakota.

Governing law

These terms, and any agreement between you and Sterling Sioux Falls Concrete Company, are governed by the laws of the State of South Dakota, without regard to its conflict of law rules.

Changes to these terms

We may update these terms from time to time. The version posted on this page is the one that applies when you use the site. Changes don't affect a contract you've already signed unless we both agree in writing.

If you have questions about these terms, you can learn more about us on our About page or get in touch through our Contact page. We respond within 1 business day.
